The legal framework
Nicotine pouches in Italy fall under excise law — specifically Art. 62-quater.1 of the consolidated excise rules (D. Lgs. 26 October 1995, n. 504). Manufacturing, circulation and sale require authorization from the Italian customs and monopolies authority (ADM).
The 2026 change
The Budget Law 2026 (Law of 30 December 2025, n. 199) amended Art. 62-quater.1 to prohibit distance sales of nicotine pouches, including cross-border / transfrontier distance sales. The change also raised penalties — fines up to €150,000 — with the stated aim of protecting the regulated market.
This matters a lot: it closes the cross-border online route into Italy that had been a major channel.
