FDA authorization is the gate
The FDA regulates nicotine pouches as tobacco products. Any nicotine pouch sold in the US needs FDA premarket authorization (a PMTA).
The FDA maintains an up-to-date list of all authorized nicotine pouch products — and explicitly says these are the only nicotine pouch products that may be lawfully sold in the United States. The list currently centers on on! (Helix Innovations) products, including on! PLUS nicotine pouches.
Age and where they're sold
- Buyers must be 21 or older (federal minimum age for tobacco products).
- Authorized products can be sold through retail channels that comply with FDA marketing rules — commonly convenience stores, tobacco shops and online retailers that verify age.
- Any product not on the FDA's authorized list is being marketed without authorization and is not lawful.
Enforcement and state rules
The FDA also issues guidance on enforcement priorities for new tobacco products marketed without premarket authorization, and individual states layer their own rules on top (such as flavor restrictions or local taxes).
What to check
If you're buying pouches in the US, check the FDA's authorized nicotine pouch products page to confirm a product has marketing authorization before assuming it's lawfully sold.
